Terms of Service

Effective date: July 3, 2026

1. Who We Are; Agreement to These Terms

These Terms of Service (the "Terms") are a binding agreement between you and the operator of the CharaGo mobile application, the charago.app website, and related services (collectively, the "Service" — "CharaGo," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You can reach us anytime at support@charago.app.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. If you reside in the Republic of Korea and are under 14, you may use the Service only with the consent of a legal guardian. Where local law sets a higher minimum age or additional consent requirements, those apply.

3. Your Account

You sign in with your Apple or Google account. You agree to provide accurate information, keep your sign-in credentials secure, and accept responsibility for activity under your account. Tell us promptly at support@charago.app if you suspect unauthorized use. We may suspend or terminate accounts as described in Section 13.

4. The Service

CharaGo lets you create characters — from a photo of your pet, plushie, or toy, from your own original artwork, or by generating ("adopting") a new character with AI — and then generate short AI videos that place your character into photos and videos you capture. You can post as your characters in the community feed, follow other characters, and collaborate with other creators. Features may change: we may add, modify, or discontinue features at any time, and will give reasonable notice of material reductions where practical.

5. Credits, Subscriptions, and Payments

Credits. Generating videos and images consumes credits. Credits are a limited, personal, non-transferable, revocable license to use Service features. Credits are not money, property, or a deposit; they have no cash value and cannot be redeemed for cash. The credit cost of a generation is shown before you confirm it, and we may adjust credit pricing prospectively.
Purchases. All purchases are made through the Apple App Store or Google Play and are billed by them under their terms. We never receive or store your card details.
Subscriptions. Subscriptions renew automatically each month until you cancel in your App Store or Google Play account settings (cancel at least 24 hours before the period ends). Your monthly credit allowance refills on renewal as described in the app. Upgrades take effect immediately (we add the credit difference right away); downgrades take effect at the next renewal.
Top-ups. Credits from one-time top-up purchases do not expire.
Failed generations. If a generation fails on our side, the credits charged for that job are automatically refunded to your balance.
Refunds. Except for the automatic credit refunds above, purchases are non-refundable to the extent permitted by law; refund requests for store purchases are handled under Apple's or Google's refund policies and any mandatory consumer rights you have.

6. Your Content and Licenses

(a) Your content. "User Content" means everything you upload or create on the Service — character images and reference photos, the photos and videos you capture or upload, text prompts, character names and bios, posts and comments — and "Outputs" means the AI-generated videos and images produced for you.

(b) Ownership. As between you and CharaGo, you retain your rights in your User Content, and you own the Outputs generated for you, to the extent permitted by applicable law. We make no promise that Outputs are protectable by copyright in any jurisdiction.

(c) License to us. You grant us a worldwide, non-exclusive, royalty-free license — sublicensable to the service providers who help us run the Service — to host, store, reproduce, process, adapt (for technical purposes), publicly display, and distribute your User Content and Outputs, in each case as needed to operate, provide, secure, and improve the Service. For content you choose to make public, this license also covers featuring and promoting that content within the Service (for example in the community feed, discovery surfaces, or featured placements). The license ends when you delete the content or your account, except that (i) collab content may remain visible as described below, (ii) content others have re-shared within the Service may persist in those contexts, and (iii) copies may remain in routine backups for a limited period or where retention is required by law.

(d) Collabs. A collab pairs characters from different creators in one video. Collab videos appear on the profiles of all participating characters, and each participant authorizes that display. Deleting a character removes its solo videos; collab videos may remain visible on the other participants' profiles.

(e) Responsibility. You are solely responsible for your User Content. Only upload content you own or have permission to use — including the character design itself. Do not upload characters, artwork, or other material belonging to third parties without authorization.

(f) Feedback. If you send us ideas or suggestions, we may use them without restriction or compensation.

7. AI-Generated Content

Outputs are produced by artificial-intelligence models. You understand and agree that: (a) Outputs may contain errors or artifacts and are provided without any guarantee of accuracy or fitness for a particular purpose; (b) similar prompts may produce similar results for different users, and no exclusivity in Outputs is promised; (c) Outputs may unintentionally resemble existing works — you are responsible for reviewing Outputs before using them, especially commercially; (d) when you share AI-generated content on other platforms, you are responsible for complying with those platforms' rules and any applicable AI-disclosure requirements; and (e) you must not generate content using the face, voice, or likeness of a real person without that person's consent. We and our providers may decline, filter, or block generation requests.

8. Acceptable Use

You agree not to:

infringe anyone's intellectual property, privacy, or publicity rights — including by uploading third-party characters or artwork without authorization;
create, upload, or share any sexual content involving minors — zero tolerance; we report such material to relevant authorities;
create or share pornographic, sexually exploitative, or gratuitously violent content;
harass, threaten, defame, or promote hatred against any person or group;
impersonate any person or entity, or create deceptive "deepfake" content of real people;
use the Service for anything unlawful, or upload malware or harmful code;
scrape the Service, access it by automated means, or reverse engineer any part of it;
circumvent or manipulate the credit system, content filters, or security measures;
present AI-generated content as authentic footage of real events or people in order to mislead; or
violate Apple's or Google's store policies when using the app.

9. Moderation and Enforcement

We may — but are not obligated to — screen content using automated tools (such as keyword filters) and human review. We may remove or restrict content, limit features, or suspend or terminate accounts that we reasonably believe violate these Terms or create risk for users, third parties, or CharaGo. Accounts of repeat infringers will be terminated. If termination results from your material breach of these Terms, unused credits may be forfeited to the extent permitted by applicable law. To report content or behavior, email support@charago.app with a link or screenshot and a short description.

10. Intellectual-Property Complaints

If you believe content on the Service infringes your rights, send a notice to support@charago.app including: (a) identification of the protected work; (b) where the allegedly infringing material appears in the Service; (c) your contact information; (d) a good-faith statement that the use is unauthorized; (e) a statement, under penalty of perjury where applicable, that your notice is accurate and that you are the rights holder or authorized to act for them; and (f) your physical or electronic signature. We may remove the material and notify the uploader, who may submit a counter-notice. We terminate repeat infringers.

11. Third-Party Services; App Store Terms

Sign-in with Apple or Google is subject to their terms. External communities we link to (such as our Discord server) are operated by third parties under their own terms and policies.

If you downloaded the app from the Apple App Store, the following applies: these Terms are between you and CharaGo only — not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support. In the event the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability claims, legal or regulatory compliance claims, or consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties, and you agree to comply with the Usage Rules in Apple's Terms of Service. If you downloaded the app from Google Play, Google Play's terms apply correspondingly.

12. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Service will be uninterrupted, secure, or error-free, or that Outputs will meet your expectations. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you; nothing in these Terms limits consumer rights that cannot be waived under the law of your place of residence.

13. Termination

By you: you may stop using the Service at any time and may delete your account in the app (Me → Account) or by emailing support@charago.app. By us: we may suspend or terminate your access for breach of these Terms, legal or security risk, or extended inactivity (with prior notice for inactivity). If we permanently discontinue the Service, we will give reasonable advance notice, and unused purchased credits will be handled as required by applicable law. Sections 6(c) (to the extent stated), 7, 12, 14, 15, and 16 survive termination.

14. Limitation of Liability

To the maximum extent permitted by law: (a) we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill; and (b) our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50. This limitation does not apply to liability arising from our intentional misconduct or gross negligence, to death or personal injury, or to any liability that cannot be limited under the mandatory law of your place of residence.

15. Indemnification

To the extent permitted by the law of your place of residence, you agree to indemnify and hold CharaGo harmless from third-party claims and reasonable expenses (including legal fees) arising out of your User Content or your breach of these Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region, excluding its conflict-of-law rules, and disputes shall be submitted to the courts of Hong Kong — provided that, if you use the Service as a consumer, you keep the protection of any mandatory consumer-protection rules of the country where you habitually reside, and nothing in this section deprives you of the right to bring or defend proceedings in your local courts where that right is granted by mandatory law.

17. Changes to These Terms

We may update these Terms from time to time. For material changes we will give notice in the app or on our website reasonably in advance of the effective date. Your continued use of the Service after the effective date constitutes acceptance; if you do not agree, stop using the Service and delete your account.

18. Miscellaneous; Contact

These Terms (with the Privacy Policy) are the entire agreement between you and CharaGo about the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms to an affiliate or successor of the Service; you may not assign them. These Terms may be published in several languages; the English version controls in case of any inconsistency. Questions: support@charago.app.

1. 当事者・規約への同意

本利用規約（以下「本規約」）は、お客様と、CharaGoモバイルアプリ、charago.appウェブサイトおよび関連サービス（総称して「本サービス」。以下、その運営者を「CharaGo」「当社」「私たち」といいます）の運営者との間の法的拘束力のある契約です。アカウントを作成し、または本サービスを利用することにより、お客様は本規約およびプライバシーポリシーに同意したものとみなされます。同意いただけない場合は、本サービスをご利用にならないでください。お問い合わせは support@charago.app までいつでもどうぞ。

2. 利用資格

本サービスは13歳以上の方がご利用いただけます。お住まいの地域の成年年齢に達していない場合は、親権者または法定代理人が本規約を確認し、お客様に代わって同意する必要があります。大韓民国にお住まいで14歳未満の場合は、法定代理人の同意がある場合に限り利用できます。現地法がより高い年齢制限や追加の同意要件を定める場合は、それに従います。

3. アカウント

サインインにはAppleまたはGoogleのアカウントを使用します。お客様は、正確な情報を提供し、サインイン情報を安全に管理し、自身のアカウントでの活動について責任を負うことに同意します。不正利用の疑いがある場合は、速やかに support@charago.app までご連絡ください。当社は第13条に定めるとおりアカウントを停止または解約することがあります。

4. 本サービスの内容

CharaGoでは、ペット・ぬいぐるみ・おもちゃの写真や、ご自身のオリジナルイラストからキャラクターを作成できるほか、AIで新しいキャラクターを生成（「アドプト」）することもできます。そして、お客様が撮影した写真や動画の中にキャラクターを登場させる短いAI動画を生成できます。コミュニティフィードでキャラクターとして投稿したり、他のキャラクターをフォローしたり、他のクリエイターとコラボすることもできます。機能は変更されることがあります。当社はいつでも機能を追加・変更・終了することができ、重要な縮小については可能な範囲で合理的な通知を行います。

5. クレジット・サブスクリプション・支払い

クレジット。動画・画像の生成にはクレジットを消費します。クレジットは、本サービスの機能を利用するための限定的・個人的・譲渡不能・取消可能なライセンスであり、金銭・財産・預り金ではなく、換金価値はありません。生成にかかるクレジット数は確定前に表示され、当社は将来に向かってクレジット価格を変更することがあります。
購入。すべての購入はApple App StoreまたはGoogle Playを通じて行われ、各ストアの規約に基づき請求されます。当社がお客様のカード情報を受領・保存することはありません。
サブスクリプション。サブスクリプションは、App StoreまたはGoogle Playのアカウント設定で解約するまで毎月自動更新されます（期間終了の24時間前までに解約してください）。月間クレジットはアプリ内の説明のとおり更新時に補充されます。アップグレードは即時に適用され（差分クレジットを直ちに付与）、ダウングレードは次回更新時に適用されます。
チャージ（買い切り）。買い切りチャージで取得したクレジットに有効期限はありません。
生成失敗時。当社側の原因で生成が失敗した場合、そのジョブに課金されたクレジットは自動的に残高へ返還されます。
返金。上記の自動返還を除き、法律で認められる範囲で購入は返金不可です。ストア購入の返金は、AppleまたはGoogleの返金ポリシーおよびお客様が有する強行法規上の消費者の権利に従って処理されます。

6. お客様のコンテンツとライセンス

(a) ユーザーコンテンツ。「ユーザーコンテンツ」とは、お客様が本サービス上でアップロードまたは作成するすべて（キャラクター画像・参照写真、撮影・アップロードした写真や動画、テキストプロンプト、キャラクター名やプロフィール、投稿・コメント）をいい、「生成物」とは、お客様のために生成されたAI動画・画像をいいます。

(b) 権利の帰属。お客様と当社の間では、ユーザーコンテンツに関するお客様の権利はお客様に留保され、適用法で認められる範囲で、お客様のために生成された生成物はお客様に帰属します。生成物がいずれかの法域で著作権保護の対象となることを当社は保証しません。

(c) 当社へのライセンス。お客様は当社に対し、本サービスの運営・提供・保護・改善に必要な範囲で、ユーザーコンテンツおよび生成物をホスト・保存・複製・処理・（技術的目的での）改変・公に表示・配信するための、全世界的・非独占的・無償のライセンス（本サービスの運営を支援するサービス提供者へのサブライセンスを含む）を付与します。お客様が公開したコンテンツについては、このライセンスには本サービス内（コミュニティフィード、発見面、フィーチャー枠など）での紹介・プロモーションも含まれます。ライセンスは、お客様がコンテンツまたはアカウントを削除した時点で終了します。ただし、(i) コラボコンテンツは下記のとおり表示され続けることがあり、(ii) 他のユーザーが本サービス内で再共有したコンテンツは当該文脈で残ることがあり、(iii) 通常のバックアップには一定期間、また法令上保存が必要な場合にはその範囲で、複製が残ることがあります。

(d) コラボ。コラボは、異なるクリエイターのキャラクターを1本の動画で共演させる機能です。コラボ動画は参加した全キャラクターのプロフィールに表示され、各参加者はその表示を承諾します。キャラクターを削除するとそのソロ動画は削除されますが、コラボ動画は他の参加者のプロフィールに表示され続けることがあります。

(e) 責任。ユーザーコンテンツについては、お客様が単独で責任を負います。アップロードできるのは、お客様が権利を有するか、使用許諾を得ているコンテンツのみです（キャラクターデザイン自体を含みます）。第三者のキャラクター、イラストその他の素材を、許諾なくアップロードしないでください。

(f) フィードバック。お客様から提案やアイデアをいただいた場合、当社は制限なく、対価なしにこれを利用できます。

7. AI生成コンテンツ

生成物は人工知能モデルによって生成されます。お客様は以下を理解し同意します。(a) 生成物には誤りやアーティファクトが含まれることがあり、正確性や特定目的への適合性は保証されません。(b) 類似のプロンプトからは、他のユーザーにも類似の結果が生成されることがあり、生成物の独占性は保証されません。(c) 生成物は既存の著作物に意図せず類似することがあります。特に商用利用の前には、お客様が生成物を確認する責任を負います。(d) 生成コンテンツを他のプラットフォームで共有する際は、当該プラットフォームのルールおよび適用されるAI表示義務の遵守はお客様の責任です。(e) 実在の人物の顔・声・肖像を、本人の同意なく用いて生成してはなりません。当社および当社のサービス提供者は、生成リクエストを拒否・フィルタリング・ブロックすることがあります。

8. 禁止事項

お客様は以下の行為を行わないことに同意します。

第三者の知的財産権・プライバシー・パブリシティ権の侵害（許諾のない第三者キャラクターやイラストのアップロードを含む）
未成年者を対象とする性的コンテンツの作成・アップロード・共有 —— 一切許容しません。当該コンテンツは関係当局に通報します
ポルノグラフィ、性的搾取的、または過度に暴力的なコンテンツの作成・共有
個人または集団に対する嫌がらせ、脅迫、名誉毀損、憎悪の助長
人物・団体のなりすまし、実在の人物の欺瞞的な「ディープフェイク」コンテンツの作成
違法な目的での利用、マルウェア等の有害なコードのアップロード
本サービスのスクレイピング、自動化された手段によるアクセス、リバースエンジニアリング
クレジットシステム、コンテンツフィルター、セキュリティ対策の回避・不正操作
AI生成コンテンツを実在の出来事や人物の本物の映像と偽って誤解を招く行為
アプリ利用時のAppleまたはGoogleのストアポリシー違反

9. モデレーションと執行

当社は、自動化ツール（キーワードフィルター等）および人によるレビューでコンテンツを審査することがあります（義務ではありません）。本規約に違反する、またはユーザー・第三者・CharaGoにリスクをもたらすと合理的に判断したコンテンツの削除・制限、機能の制限、アカウントの停止・解約を行うことがあります。反復的な侵害者のアカウントは解約します。お客様の重大な違反により解約となった場合、適用法で認められる範囲で未使用クレジットは失効することがあります。コンテンツや行為の通報は、リンクまたはスクリーンショットと簡単な説明を添えて support@charago.app までお寄せください。

10. 知的財産権侵害の申立て

本サービス上のコンテンツがお客様の権利を侵害しているとお考えの場合は、次の事項を記載した通知を support@charago.app までお送りください。(a) 保護される著作物の特定、(b) 侵害が疑われる素材の本サービス内での所在、(c) お客様の連絡先、(d) 当該使用が権利者の許諾を得ていないと信じる旨の誠実な陳述、(e) 通知内容が正確であり、お客様が権利者本人またはその代理権限を有する旨の陳述（適用される場合は偽証罪の制裁のもとで）、(f) 物理的または電子的署名。当社は素材を削除のうえアップロード者に通知することがあり、アップロード者は異議申立て（カウンターノーティス）を行うことができます。反復的な侵害者は解約します。

11. 第三者サービス・アプリストア条項

AppleまたはGoogleによるサインインには各社の規約が適用されます。当社がリンクする外部コミュニティ（Discordサーバー等）は第三者が運営しており、それぞれの規約とポリシーが適用されます。

Apple App Storeからアプリをダウンロードした場合、次の条項が適用されます。本規約はお客様とCharaGoとの間のものであり、Appleは当事者ではありません。Appleはアプリおよびそのコンテンツについて責任を負わず、保守・サポートを提供する義務を負いません。アプリが適用される保証に適合しない場合、お客様はAppleに通知でき、Appleはアプリの購入代金（ある場合）を返金します。法律で認められる最大限の範囲で、Appleはその他の保証義務を負いません。Appleは、製造物責任、法令遵守、消費者保護に関する請求を含め、アプリに関する請求への対応について責任を負いません。Appleおよびその子会社は本規約の第三者受益者であり、お客様に対して本規約を執行する権利を有します。お客様は、米国政府の禁輸対象国に所在せず、米国政府の禁止・制限対象者リストに掲載されていないことを表明し、Appleのサービス規約の使用ルールを遵守することに同意します。Google Playからダウンロードした場合は、Google Playの規約が同様に適用されます。

12. 免責事項

本サービスは「現状有姿」および「提供可能な範囲」で提供されます。法律で認められる最大限の範囲で、当社は商品性、特定目的適合性、権利非侵害を含む明示・黙示のすべての保証を否認し、本サービスが中断せず、安全で、エラーがないこと、生成物がお客様の期待に沿うことを保証しません。一部の法域では特定の免責が認められないため、本条の一部はお客様に適用されない場合があります。本規約のいかなる規定も、お客様の居住地の法律上放棄できない消費者の権利を制限するものではありません。

13. 解約・終了

お客様による終了：いつでも利用を中止でき、アプリ内（Me → Account）またはsupport@charago.appへのメールでアカウントを削除できます。当社による終了：本規約違反、法的リスクやセキュリティ上のリスク、長期間の未利用（未利用の場合は事前通知のうえ）を理由に、アクセスを停止または終了することがあります。本サービスを恒久的に終了する場合は合理的な事前通知を行い、未使用の購入済みクレジットは適用法の要求に従って取り扱います。第6条(c)（明示の範囲で）、第7条、第12条、第14条、第15条、第16条は終了後も存続します。

14. 責任の制限

法律で認められる最大限の範囲で、(a) 当社は間接損害、付随的損害、特別損害、結果損害、懲罰的損害、および逸失利益・データ・信用の喪失について責任を負わず、(b) 本サービスに関する当社の責任の総額は、請求の原因となった事象の前12か月間にお客様が当社に支払った金額、または50米ドルのいずれか高い方を上限とします。この制限は、当社の故意または重過失に起因する責任、死亡または人身傷害、およびお客様の居住地の強行法規上制限できない責任には適用されません。

15. 補償

お客様の居住地の法律で認められる範囲で、お客様は、ユーザーコンテンツまたは本規約違反に起因する第三者からの請求および合理的な費用（弁護士費用を含む）について、CharaGoを補償し、損害を与えないことに同意します。

16. 準拠法・紛争解決

本規約は、抵触法の規則を除き、香港特別行政区の法律に準拠し、紛争は香港の裁判所に付託されるものとします。ただし、お客様が消費者として本サービスを利用する場合、お客様は常居所地国の強行的な消費者保護規定による保護を失わず、本条のいかなる規定も、強行法規により認められる場合にお客様が現地の裁判所で訴訟を提起または防御する権利を奪うものではありません。

17. 本規約の変更

当社は本規約を随時更新することがあります。重要な変更については、発効日より合理的な期間前に、アプリ内またはウェブサイト上で通知します。発効日以降も本サービスの利用を継続した場合、変更に同意したものとみなされます。同意いただけない場合は、利用を中止し、アカウントを削除してください。

18. その他・お問い合わせ

本規約（プライバシーポリシーを含む）は、本サービスに関するお客様と当社との完全な合意です。いずれかの条項が執行不能とされた場合でも、残りの条項は有効に存続します。当社が条項を執行しないことは権利放棄ではありません。当社は本規約を関連会社または本サービスの承継者に譲渡できますが、お客様は譲渡できません。本規約は複数の言語で公開されることがあります。相違がある場合は英語版が優先します。お問い合わせ：support@charago.app

2. 이용 자격

본 서비스는 만 13세 이상만 이용할 수 있습니다. 거주 지역의 성년 연령에 도달하지 않은 경우, 부모 또는 법정대리인이 본 약관을 검토하고 귀하를 대신하여 동의해야 합니다. 대한민국에 거주하는 만 14세 미만 아동은 법정대리인의 동의가 있는 경우에만 이용할 수 있습니다. 현지 법률이 더 높은 최소 연령 또는 추가 동의 요건을 정한 경우 그에 따릅니다.

3. 계정

로그인에는 Apple 또는 Google 계정을 사용합니다. 귀하는 정확한 정보를 제공하고, 로그인 정보를 안전하게 관리하며, 귀하의 계정에서 이루어지는 활동에 대해 책임을 지는 데 동의합니다. 무단 사용이 의심되는 경우 즉시 support@charago.app으로 알려 주십시오. 당사는 제13조에 따라 계정을 정지하거나 해지할 수 있습니다.

4. 서비스 내용

CharaGo에서는 반려동물·인형·장난감 사진이나 직접 그린 오리지널 아트로 캐릭터를 만들 수 있으며, AI로 새 캐릭터를 생성("입양")할 수도 있습니다. 그리고 귀하가 촬영한 사진과 영상 속에 캐릭터를 등장시키는 짧은 AI 영상을 생성할 수 있습니다. 커뮤니티 피드에서 캐릭터로서 게시하고, 다른 캐릭터를 팔로우하고, 다른 크리에이터와 콜라보할 수 있습니다. 기능은 변경될 수 있습니다. 당사는 언제든지 기능을 추가·변경·중단할 수 있으며, 중대한 축소에 대해서는 가능한 범위에서 합리적으로 통지합니다.

5. 크레딧, 구독 및 결제

크레딧. 영상·이미지 생성에는 크레딧이 소모됩니다. 크레딧은 본 서비스 기능을 이용하기 위한 제한적·개인적·양도 불가·취소 가능한 이용권이며, 금전·재산·예치금이 아니고 현금 가치가 없으며 현금으로 환급되지 않습니다. 생성에 필요한 크레딧 수는 확정 전에 표시되며, 당사는 장래를 향하여 크레딧 가격을 조정할 수 있습니다.
구매. 모든 구매는 Apple App Store 또는 Google Play를 통해 이루어지며 각 스토어의 약관에 따라 청구됩니다. 당사는 귀하의 카드 정보를 수신하거나 저장하지 않습니다.
구독. 구독은 App Store 또는 Google Play 계정 설정에서 해지할 때까지 매월 자동 갱신됩니다(기간 종료 최소 24시간 전에 해지). 월간 크레딧은 앱 내 안내에 따라 갱신 시 충전됩니다. 업그레이드는 즉시 적용되며(차액 크레딧 즉시 지급), 다운그레이드는 다음 갱신 시 적용됩니다.
단건 충전. 단건 충전으로 구매한 크레딧은 만료되지 않습니다.
생성 실패. 당사 측 원인으로 생성이 실패한 경우, 해당 작업에 청구된 크레딧은 자동으로 잔액에 환급됩니다.
환불. 위 자동 환급을 제외하고, 법률이 허용하는 범위에서 구매는 환불되지 않습니다. 스토어 구매 환불은 Apple 또는 Google의 환불 정책 및 귀하의 강행법상 소비자 권리에 따라 처리됩니다.

6. 귀하의 콘텐츠와 라이선스

(a) 사용자 콘텐츠. "사용자 콘텐츠"란 귀하가 본 서비스에 업로드하거나 생성하는 모든 것(캐릭터 이미지·참조 사진, 촬영·업로드한 사진과 영상, 텍스트 프롬프트, 캐릭터 이름과 소개, 게시물과 댓글)을 말하며, "산출물"이란 귀하를 위해 생성된 AI 영상·이미지를 말합니다.

(b) 권리 귀속. 귀하와 당사 사이에서, 사용자 콘텐츠에 대한 귀하의 권리는 귀하에게 유보되며, 적용 법률이 허용하는 범위에서 귀하를 위해 생성된 산출물은 귀하에게 귀속됩니다. 당사는 산출물이 어느 법역에서든 저작권 보호 대상이 됨을 보증하지 않습니다.

(c) 당사에 대한 라이선스. 귀하는 당사에, 본 서비스의 운영·제공·보호·개선에 필요한 범위에서 사용자 콘텐츠와 산출물을 호스팅·저장·복제·처리·(기술적 목적의) 각색·공개 표시·배포할 수 있는 전 세계적·비독점적·무상의 라이선스(본 서비스 운영을 지원하는 서비스 제공자에 대한 재라이선스 포함)를 부여합니다. 귀하가 공개로 설정한 콘텐츠의 경우, 이 라이선스에는 본 서비스 내(커뮤니티 피드, 발견 화면, 추천 배치 등)에서의 소개·홍보도 포함됩니다. 라이선스는 귀하가 콘텐츠 또는 계정을 삭제한 시점에 종료됩니다. 다만 (i) 콜라보 콘텐츠는 아래와 같이 계속 표시될 수 있고, (ii) 다른 이용자가 서비스 내에서 재공유한 콘텐츠는 해당 맥락에 남을 수 있으며, (iii) 통상적인 백업에는 일정 기간, 법령상 보존이 요구되는 경우에는 그 범위에서 사본이 남을 수 있습니다.

(d) 콜라보. 콜라보는 서로 다른 크리에이터의 캐릭터를 한 영상에 함께 등장시키는 기능입니다. 콜라보 영상은 참여한 모든 캐릭터의 프로필에 표시되며, 각 참여자는 그 표시에 동의합니다. 캐릭터를 삭제하면 해당 캐릭터의 단독 영상은 삭제되지만, 콜라보 영상은 다른 참여자의 프로필에 계속 표시될 수 있습니다.

(e) 책임. 사용자 콘텐츠에 대해서는 귀하가 단독으로 책임을 집니다. 귀하가 권리를 보유하거나 사용 허락을 받은 콘텐츠만 업로드하십시오(캐릭터 디자인 자체를 포함합니다). 제3자의 캐릭터, 아트워크 등 자료를 허락 없이 업로드하지 마십시오.

(f) 피드백. 귀하가 아이디어나 제안을 보내는 경우, 당사는 제한이나 대가 없이 이를 사용할 수 있습니다.

7. AI 생성 콘텐츠

산출물은 인공지능 모델에 의해 생성됩니다. 귀하는 다음을 이해하고 동의합니다. (a) 산출물에는 오류나 아티팩트가 포함될 수 있으며 정확성이나 특정 목적 적합성은 보장되지 않습니다. (b) 유사한 프롬프트는 다른 이용자에게도 유사한 결과를 생성할 수 있으며, 산출물의 독점성은 약속되지 않습니다. (c) 산출물은 기존 저작물과 의도치 않게 유사할 수 있습니다. 특히 상업적으로 사용하기 전에 산출물을 검토할 책임은 귀하에게 있습니다. (d) 생성 콘텐츠를 다른 플랫폼에 공유할 때 해당 플랫폼의 규칙 및 적용되는 AI 표시 의무 준수는 귀하의 책임입니다. (e) 실존 인물의 얼굴·음성·초상을 본인 동의 없이 사용하여 생성해서는 안 됩니다. 당사와 당사의 서비스 제공자는 생성 요청을 거부·필터링·차단할 수 있습니다.

8. 금지 행위

귀하는 다음 행위를 하지 않을 것에 동의합니다.

타인의 지식재산권·프라이버시·퍼블리시티권 침해(허락 없는 제3자 캐릭터·아트워크 업로드 포함)
미성년자를 대상으로 하는 성적 콘텐츠의 생성·업로드·공유 — 무관용 원칙. 해당 자료는 관계 당국에 신고합니다
음란물, 성 착취적 또는 과도하게 폭력적인 콘텐츠의 생성·공유
개인 또는 집단에 대한 괴롭힘, 협박, 명예훼손, 증오 조장
인물·단체 사칭, 실존 인물에 대한 기만적 "딥페이크" 콘텐츠 제작
불법적 목적의 이용, 악성코드 등 유해한 코드 업로드
본 서비스 스크래핑, 자동화 수단을 통한 접근, 리버스 엔지니어링
크레딧 시스템, 콘텐츠 필터, 보안 조치의 우회·조작
AI 생성 콘텐츠를 실제 사건이나 인물의 진짜 영상인 것처럼 속여 오인을 유발하는 행위
앱 이용 시 Apple 또는 Google 스토어 정책 위반

9. 모더레이션 및 조치

당사는 자동화 도구(키워드 필터 등)와 사람의 검토로 콘텐츠를 심사할 수 있습니다(의무는 아닙니다). 본 약관을 위반하거나 이용자·제3자·CharaGo에 위험을 초래한다고 합리적으로 판단되는 콘텐츠의 삭제·제한, 기능 제한, 계정 정지·해지를 할 수 있습니다. 반복 침해자의 계정은 해지됩니다. 귀하의 중대한 위반으로 해지되는 경우, 적용 법률이 허용하는 범위에서 미사용 크레딧은 소멸될 수 있습니다. 콘텐츠나 행위를 신고하려면 링크 또는 스크린샷과 간단한 설명을 support@charago.app으로 보내 주십시오.

10. 지식재산권 침해 신고

본 서비스의 콘텐츠가 귀하의 권리를 침해한다고 판단되는 경우, 다음 사항을 기재한 통지를 support@charago.app으로 보내 주십시오. (a) 보호되는 저작물의 특정, (b) 침해가 의심되는 자료의 서비스 내 위치, (c) 귀하의 연락처, (d) 해당 사용이 권리자의 허락을 받지 않았다고 믿는다는 선의의 진술, (e) 통지 내용이 정확하며 귀하가 권리자 본인이거나 그 대리 권한이 있다는 진술(해당되는 경우 위증 시 처벌을 감수한다는 취지 포함), (f) 물리적 또는 전자적 서명. 당사는 자료를 삭제하고 업로더에게 통지할 수 있으며, 업로더는 이의(반대 통지)를 제기할 수 있습니다. 반복 침해자는 해지됩니다.

11. 제3자 서비스 및 앱 스토어 조항

Apple 또는 Google 로그인에는 각사의 약관이 적용됩니다. 당사가 링크하는 외부 커뮤니티(Discord 서버 등)는 제3자가 운영하며 각자의 약관과 정책이 적용됩니다.

Apple App Store에서 앱을 다운로드한 경우 다음이 적용됩니다. 본 약관은 귀하와 CharaGo 간의 것이며 Apple은 당사자가 아닙니다. Apple은 앱과 그 콘텐츠에 대해 책임지지 않으며 유지보수·지원을 제공할 의무가 없습니다. 앱이 적용 가능한 보증에 부합하지 않는 경우 귀하는 Apple에 통지할 수 있고 Apple은 앱 구매 대금(있는 경우)을 환불합니다. 법률이 허용하는 최대 범위에서 Apple은 그 밖의 보증 의무를 지지 않습니다. Apple은 제조물 책임, 법령 준수, 소비자 보호 관련 청구를 포함하여 앱에 관한 청구 대응에 책임이 없습니다. Apple과 그 자회사는 본 약관의 제3수익자로서 귀하에 대해 본 약관을 집행할 권리를 가집니다. 귀하는 미국 정부의 금수 대상 국가에 있지 않으며 미국 정부의 금지·제한 대상자 명단에 등재되어 있지 않음을 진술하고, Apple 서비스 약관의 사용 규칙을 준수할 것에 동의합니다. Google Play에서 다운로드한 경우 Google Play 약관이 상응하게 적용됩니다.

12. 보증의 부인

본 서비스는 "있는 그대로" 그리고 "제공 가능한 범위에서" 제공됩니다. 법률이 허용하는 최대 범위에서 당사는 상품성, 특정 목적 적합성, 권리 비침해를 포함한 명시적·묵시적 일체의 보증을 부인하며, 본 서비스가 중단 없이 안전하고 오류 없이 제공된다거나 산출물이 귀하의 기대에 부합함을 보증하지 않습니다. 일부 법역에서는 특정 면책이 허용되지 않으므로 본 조의 일부는 귀하에게 적용되지 않을 수 있습니다. 본 약관의 어떤 조항도 귀하의 거주지 법률상 포기할 수 없는 소비자 권리를 제한하지 않습니다.

13. 해지

귀하에 의한 해지: 언제든지 이용을 중단할 수 있으며, 앱 내(Me → Account)에서 또는 support@charago.app으로 이메일을 보내 계정을 삭제할 수 있습니다. 당사에 의한 해지: 본 약관 위반, 법적·보안상 위험, 장기간 미사용(미사용의 경우 사전 통지 후)을 이유로 접근을 정지하거나 종료할 수 있습니다. 본 서비스를 영구적으로 종료하는 경우 합리적인 사전 통지를 하며, 미사용 유료 크레딧은 적용 법률의 요구에 따라 처리합니다. 제6조 (c)(명시된 범위), 제7조, 제12조, 제14조, 제15조, 제16조는 해지 후에도 존속합니다.

14. 책임의 제한

법률이 허용하는 최대 범위에서 (a) 당사는 간접·부수적·특별·결과적·징벌적 손해 및 이익·데이터·신용의 상실에 대해 책임지지 않으며, (b) 본 서비스와 관련된 당사의 총 책임은 청구 원인이 된 사건 전 12개월 동안 귀하가 당사에 지급한 금액 또는 미화 50달러 중 큰 금액을 한도로 합니다. 이 제한은 당사의 고의 또는 중과실로 인한 책임, 사망 또는 인신 상해, 귀하의 거주지 강행 법규상 제한할 수 없는 책임에는 적용되지 않습니다.

15. 면책

귀하의 거주지 법률이 허용하는 범위에서, 귀하는 귀하의 사용자 콘텐츠 또는 본 약관 위반으로 인해 발생하는 제3자의 청구 및 합리적인 비용(변호사 비용 포함)으로부터 CharaGo를 면책하고 손해가 없도록 하는 데 동의합니다.

16. 준거법 및 분쟁 해결

본 약관은 국제사법 규칙을 제외하고 홍콩특별행정구 법률에 따라 규율되며, 분쟁은 홍콩 법원에 제기합니다. 다만, 귀하가 소비자로서 본 서비스를 이용하는 경우 귀하는 상거소지 국가의 강행적 소비자 보호 규정에 따른 보호를 상실하지 않으며, 본 조의 어떤 규정도 강행 법규가 인정하는 경우 귀하가 현지 법원에서 소를 제기하거나 방어할 권리를 박탈하지 않습니다.

17. 약관의 변경

당사는 본 약관을 수시로 업데이트할 수 있습니다. 중대한 변경의 경우 발효일로부터 합리적인 기간 전에 앱 또는 웹사이트에서 통지합니다. 발효일 이후에도 본 서비스를 계속 이용하면 변경에 동의한 것으로 간주됩니다. 동의하지 않는 경우 이용을 중단하고 계정을 삭제하십시오.

18. 기타 및 문의

본 약관(개인정보 처리방침 포함)은 본 서비스에 관한 귀하와 당사 간의 완전한 합의입니다. 어느 조항이 집행 불가능하다고 판단되더라도 나머지 조항은 유효합니다. 당사가 조항을 집행하지 않는 것은 권리 포기가 아닙니다. 당사는 본 약관을 계열사 또는 서비스 승계인에게 양도할 수 있으나 귀하는 양도할 수 없습니다. 본 약관은 여러 언어로 게시될 수 있으며, 불일치가 있는 경우 영어 원문이 우선합니다. 문의: support@charago.app

1. 締約雙方與條款接受

本服務條款（下稱「本條款」）是您與 CharaGo 行動應用程式、charago.app 網站及相關服務（合稱「本服務」，其營運者下稱「CharaGo」、「我們」）營運者之間具法律拘束力的協議。您建立帳號或使用本服務，即表示同意本條款及我們的隱私政策。若您不同意，請勿使用本服務。任何問題歡迎隨時來信 support@charago.app。

2. 使用資格

您須年滿 13 歲方可使用本服務。若您未達居住地的成年年齡，須由父母或法定代理人審閱本條款並代為同意。若您居住於大韓民國且未滿 14 歲，須經法定代理人同意方可使用。若當地法律訂有更高的年齡門檻或額外同意要求，從其規定。

3. 您的帳號

您以 Apple 或 Google 帳號登入。您同意提供正確資訊、妥善保管登入憑證，並對帳號下的活動負責。若懷疑帳號遭未經授權使用，請儘速來信 support@charago.app。我們得依第 13 條規定停用或終止帳號。

4. 服務內容

CharaGo 讓您建立角色——可以從寵物、玩偶或玩具的照片開始，使用您自己的原創繪圖，或以 AI 生成（「領養」）一個新角色——然後生成短篇 AI 影片，把角色放進您拍攝的照片與影片裡。您可以在社群動態以角色身分發文、追蹤其他角色，並與其他創作者合作。功能可能變動：我們得隨時新增、修改或終止功能，重大縮減將在可行範圍內合理通知。

5. 點數、訂閱與付款

點數。生成影片與圖片會消耗點數。點數是使用本服務功能的有限、個人、不可轉讓、可撤銷之授權，並非金錢、財產或存款，無現金價值且不可兌現。每次生成的點數費用會在您確認前顯示，我們得對未來的點數定價進行調整。
購買。所有購買均透過 Apple App Store 或 Google Play 進行，由其依各自條款收費。我們不會收到或儲存您的卡片資料。
訂閱。訂閱每月自動續訂，直到您在 App Store 或 Google Play 帳號設定中取消（請於週期結束至少 24 小時前取消）。每月點數額度依 app 內說明於續訂時補充。升級立即生效（立刻補上點數差額）；降級於下次續訂時生效。
單次儲值。單次儲值購得的點數永不過期。
生成失敗。若因我們的原因導致生成失敗，該次扣除的點數會自動退回您的餘額。
退款。除上述自動退點外，在法律允許的範圍內購買均不退款；商店購買之退款依 Apple 或 Google 的退款政策及您依強制性法律享有的消費者權利處理。

6. 您的內容與授權

(a) 使用者內容。「使用者內容」指您在本服務上傳或建立的一切——角色圖片與參考照片、您拍攝或上傳的照片與影片、文字提示詞、角色名稱與簡介、貼文與留言；「生成物」指為您生成的 AI 影片與圖片。

(b) 權利歸屬。在您與 CharaGo 之間，您保留對使用者內容的權利；在適用法律允許的範圍內，為您生成的生成物歸您所有。我們不保證生成物在任何法域受著作權保護。

(c) 對我們的授權。您授予我們一項全球性、非專屬、免權利金的授權（可再授權予協助我們營運本服務的服務供應商），以在營運、提供、保護及改進本服務所需的範圍內，託管、儲存、重製、處理、（為技術目的）改作、公開展示及散布您的使用者內容與生成物。就您選擇公開的內容，本授權亦涵蓋在本服務內（例如社群動態、探索版面或精選位置）展示與推廣該內容。當您刪除內容或帳號時，本授權即終止，惟：(i) 合作內容可能依下述繼續顯示；(ii) 其他使用者已在本服務內轉發的內容可能保留於該情境中；(iii) 例行備份中的副本可能保留一段有限期間，或於法律要求保存時依其規定。

(d) 合作（Collab）。合作功能讓不同創作者的角色同框演出。合作影片會顯示於所有參與角色的個人檔案，各參與者均授權該顯示。刪除角色會移除其單人影片；合作影片可能仍顯示於其他參與者的個人檔案。

(e) 責任。您須對使用者內容負完全責任。僅可上傳您擁有權利或已獲授權使用的內容——包括角色設計本身。請勿未經授權上傳屬於第三方的角色、繪圖或其他素材。

(f) 意見回饋。若您向我們提供想法或建議，我們得不受限制且無償地使用。

7. AI 生成內容

生成物由人工智慧模型產生。您理解並同意：(a) 生成物可能含有錯誤或瑕疵，我們不保證其正確性或適合特定用途；(b) 相似的提示詞可能為不同使用者產生相似結果，我們不承諾生成物具排他性；(c) 生成物可能無意間與既有作品相似——使用（尤其商業使用）前，您有責任自行檢視；(d) 在其他平台分享 AI 生成內容時，您有責任遵守該平台規範及適用的 AI 標示義務；(e) 未經本人同意，不得使用真實人物的臉部、聲音或肖像進行生成。我們及我們的服務供應商得拒絕、過濾或封鎖生成請求。

8. 可接受使用

您同意不從事下列行為：

侵害他人智慧財產權、隱私權或肖像權——包括未經授權上傳第三方角色或繪圖；
製作、上傳或分享任何涉及未成年人的性內容——零容忍，我們將向有關機關通報；
製作或分享色情、性剝削或無端暴力之內容；
騷擾、威脅、誹謗任何個人或群體，或鼓吹仇恨；
冒充任何個人或實體，或製作誤導性的真人「深偽」內容；
將本服務用於任何非法目的，或上傳惡意程式或有害程式碼；
爬取本服務、以自動化方式存取，或對其任何部分進行逆向工程；
規避或操縱點數系統、內容過濾或安全措施；
將 AI 生成內容偽稱為真實事件或真實人物的真實影像以誤導他人；
使用 app 時違反 Apple 或 Google 的商店政策。

9. 內容審核與執行

我們得（但無義務）以自動化工具（如關鍵字過濾）及人工審查來審核內容。對於我們合理認為違反本條款，或對使用者、第三方或 CharaGo 造成風險的內容，我們得移除或限制之，並得限制功能、停用或終止帳號。屢次侵權者的帳號將被終止。若因您重大違約而終止，在適用法律允許的範圍內，未使用的點數可能作廢。檢舉內容或行為，請附上連結或截圖及簡要說明，寄至 support@charago.app。

10. 智慧財產權投訴

若您認為本服務上的內容侵害您的權利，請將通知寄至 support@charago.app，並載明：(a) 受保護作品之識別；(b) 涉嫌侵權素材在本服務中的位置；(c) 您的聯絡方式；(d) 善意聲明，表明該使用未經權利人授權；(e) 聲明通知內容屬實，且您為權利人或經授權代理（如適用，願受偽證處罰之拘束）；(f) 您的實體或電子簽名。我們得移除素材並通知上傳者，上傳者得提出反通知。屢次侵權者將被終止。

11. 第三方服務與應用商店條款

以 Apple 或 Google 登入須遵守其條款。我們連結的外部社群（例如我們的 Discord 伺服器）由第三方營運，適用其各自的條款與政策。

若您自 Apple App Store 下載本 app，下列條款適用：本條款僅存在於您與 CharaGo 之間，Apple 並非當事方。Apple 對本 app 及其內容不負責任，亦無提供維護或支援之義務。若本 app 不符合適用之保固，您得通知 Apple，Apple 將退還本 app 之購買價金（如有）；在法律允許的最大範圍內，Apple 不負其他保固義務。Apple 對於與本 app 相關之任何請求（包括產品責任、法規遵循或消費者保護請求）不負處理責任。Apple 及其子公司為本條款之第三方受益人，有權對您執行本條款。您聲明您並非位於受美國政府禁運之國家，亦未列於美國政府之禁止或受限制名單，並同意遵守 Apple 服務條款中的使用規則。若您自 Google Play 下載，Google Play 之條款相應適用。

12. 免責聲明

本服務以「現狀」及「現有」基礎提供。在法律允許的最大範圍內，我們否認一切明示或默示之保證，包括適售性、特定用途適合性及不侵權，且不保證本服務不中斷、安全或無錯誤，亦不保證生成物符合您的期待。部分法域不允許某些免責聲明，故本條部分內容可能不適用於您；本條款之任何內容均不限制依您居住地法律不得拋棄之消費者權利。

13. 終止

由您終止：您得隨時停止使用本服務，並可在 app 內（Me → Account）刪除帳號，或來信 support@charago.app 申請。由我們終止：因違反本條款、法律或安全風險、或長期未使用（未使用情形將事先通知），我們得停用或終止您的存取。若我們永久終止本服務，將提供合理的事前通知，未使用的已購點數將依適用法律之要求處理。第 6 條 (c)（於明示範圍內）、第 7、12、14、15、16 條於終止後繼續有效。

14. 責任限制

在法律允許的最大範圍內：(a) 我們不就間接、附隨、特別、衍生或懲罰性損害，或利潤、資料或商譽之損失負責；(b) 我們就與本服務相關之一切請求所負之總責任，以請求發生事由前 12 個月內您支付予我們之金額或 50 美元中較高者為上限。本限制不適用於因我們故意不當行為或重大過失所生之責任、死亡或人身傷害，或依您居住地強制性法律不得限制之責任。

15. 賠償

在您居住地法律允許的範圍內，您同意就因您的使用者內容或違反本條款所生之第三方請求及合理費用（包括律師費），賠償 CharaGo 並使其免受損害。

16. 準據法與爭議解決

本條款以香港特別行政區法律為準據法（排除其法律衝突規則），爭議應提交香港法院管轄。惟若您以消費者身分使用本服務，您仍保有經常居住地國強制性消費者保護規定之保障，且本條任何規定均不剝奪您依強制性法律得於當地法院起訴或應訴之權利。

17. 條款變更

我們得不時更新本條款。重大變更將於生效日前合理期間內，在 app 內或網站上通知。生效日後繼續使用本服務即視為接受變更；若不同意，請停止使用並刪除帳號。

18. 其他與聯絡方式

本條款（連同隱私政策）構成您與我們就本服務之完整合意。任一條款經認定無法執行時，其餘條款仍屬有效。我們未執行任一條款不構成棄權。我們得將本條款轉讓予關係企業或本服務之繼受者；您不得轉讓。本條款可能以多種語言發布；如有歧異，以英文版為準。聯絡方式：support@charago.app

1. Quiénes somos; aceptación de estos Términos

Estos Términos de Servicio (los "Términos") constituyen un acuerdo vinculante entre usted y el operador de la aplicación móvil CharaGo, el sitio web charago.app y los servicios relacionados (en conjunto, el "Servicio"; "CharaGo", "nosotros" o "nuestro"). Al crear una cuenta o utilizar el Servicio, usted acepta estos Términos y nuestra Política de Privacidad. Si no está de acuerdo, no utilice el Servicio. Puede contactarnos en cualquier momento en support@charago.app.

2. Requisitos de edad

Debe tener al menos 13 años para usar el Servicio. Si no ha alcanzado la mayoría de edad en su lugar de residencia, un padre, madre o tutor legal debe revisar y aceptar estos Términos en su nombre. Si reside en la República de Corea y es menor de 14 años, solo puede usar el Servicio con el consentimiento de su tutor legal. Cuando la ley local establezca una edad mínima superior o requisitos adicionales de consentimiento, estos se aplicarán.

3. Su cuenta

Usted inicia sesión con su cuenta de Apple o Google. Se compromete a proporcionar información veraz, mantener seguras sus credenciales y asumir la responsabilidad de la actividad de su cuenta. Avísenos de inmediato en support@charago.app si sospecha de un uso no autorizado. Podemos suspender o cancelar cuentas según lo descrito en la Sección 13.

4. El Servicio

CharaGo le permite crear personajes — a partir de una foto de su mascota, peluche o juguete, de su propio arte original, o generando ("adoptando") un personaje nuevo con IA — y luego generar vídeos cortos con IA que colocan a su personaje en las fotos y vídeos que usted captura. Puede publicar como sus personajes en el feed de la comunidad, seguir a otros personajes y colaborar con otros creadores. Las funciones pueden cambiar: podemos añadir, modificar o descontinuar funciones en cualquier momento, y notificaremos con antelación razonable las reducciones importantes cuando sea posible.

5. Créditos, suscripciones y pagos

Créditos. Generar vídeos e imágenes consume créditos. Los créditos son una licencia limitada, personal, intransferible y revocable para usar funciones del Servicio. No son dinero, propiedad ni un depósito; carecen de valor en efectivo y no son canjeables. El coste en créditos de una generación se muestra antes de confirmarla, y podemos ajustar los precios en créditos con efectos futuros.
Compras. Todas las compras se realizan a través del App Store de Apple o de Google Play y son facturadas por ellos conforme a sus términos. Nunca recibimos ni almacenamos los datos de su tarjeta.
Suscripciones. Las suscripciones se renuevan automáticamente cada mes hasta que las cancele en los ajustes de su cuenta del App Store o Google Play (cancele al menos 24 horas antes del final del período). Su asignación mensual de créditos se recarga en cada renovación según se describe en la app. Las mejoras de plan surten efecto de inmediato (añadimos la diferencia de créditos al instante); las bajadas de plan, en la siguiente renovación.
Recargas. Los créditos de recargas únicas no caducan.
Generaciones fallidas. Si una generación falla por causas nuestras, los créditos cobrados por ese trabajo se reembolsan automáticamente a su saldo.
Reembolsos. Salvo los reembolsos automáticos de créditos indicados, las compras no son reembolsables en la medida permitida por la ley; las solicitudes de reembolso de compras en tienda se gestionan conforme a las políticas de Apple o Google y a los derechos imperativos del consumidor que le asistan.

6. Su contenido y licencias

(a) Su contenido. "Contenido de Usuario" significa todo lo que usted sube o crea en el Servicio — imágenes de personajes y fotos de referencia, las fotos y vídeos que captura o sube, indicaciones de texto (prompts), nombres y biografías de personajes, publicaciones y comentarios — y "Resultados" significa los vídeos e imágenes generados por IA para usted.

(b) Titularidad. Entre usted y CharaGo, usted conserva sus derechos sobre su Contenido de Usuario, y es titular de los Resultados generados para usted en la medida permitida por la ley aplicable. No garantizamos que los Resultados sean protegibles por derechos de autor en ninguna jurisdicción.

(c) Licencia a nuestro favor. Usted nos concede una licencia mundial, no exclusiva y gratuita — sublicenciable a los proveedores de servicios que nos ayudan a operar el Servicio — para alojar, almacenar, reproducir, procesar, adaptar (con fines técnicos), mostrar públicamente y distribuir su Contenido de Usuario y sus Resultados, en cada caso según sea necesario para operar, prestar, proteger y mejorar el Servicio. Para el contenido que usted decida hacer público, esta licencia también cubre destacarlo y promocionarlo dentro del Servicio (por ejemplo, en el feed de la comunidad, superficies de descubrimiento o espacios destacados). La licencia termina cuando elimina el contenido o su cuenta, salvo que (i) el contenido de colaboraciones pueda seguir visible según se describe más abajo, (ii) el contenido que otros hayan vuelto a compartir dentro del Servicio pueda persistir en esos contextos, y (iii) puedan quedar copias en copias de seguridad rutinarias durante un período limitado o cuando la ley exija su conservación.

(d) Colaboraciones. Una colaboración reúne personajes de distintos creadores en un mismo vídeo. Los vídeos de colaboración aparecen en los perfiles de todos los personajes participantes, y cada participante autoriza esa exhibición. Eliminar un personaje elimina sus vídeos individuales; los vídeos de colaboración pueden seguir visibles en los perfiles de los demás participantes.

(e) Responsabilidad. Usted es el único responsable de su Contenido de Usuario. Suba únicamente contenido que le pertenezca o que tenga permiso para usar — incluido el propio diseño del personaje. No suba personajes, obras u otros materiales de terceros sin autorización.

(f) Sugerencias. Si nos envía ideas o sugerencias, podremos usarlas sin restricción ni compensación.

7. Contenido generado por IA

Los Resultados son producidos por modelos de inteligencia artificial. Usted entiende y acepta que: (a) los Resultados pueden contener errores o artefactos y se proporcionan sin garantía de exactitud o idoneidad para un fin determinado; (b) indicaciones similares pueden producir resultados similares para distintos usuarios, y no se promete exclusividad sobre los Resultados; (c) los Resultados pueden parecerse involuntariamente a obras existentes — usted es responsable de revisarlos antes de usarlos, especialmente con fines comerciales; (d) al compartir contenido generado por IA en otras plataformas, usted es responsable de cumplir las normas de esas plataformas y los requisitos aplicables de divulgación de IA; y (e) no debe generar contenido usando el rostro, la voz o la imagen de una persona real sin su consentimiento. Nosotros y nuestros proveedores podemos rechazar, filtrar o bloquear solicitudes de generación.

8. Uso aceptable

Usted se compromete a no:

infringir la propiedad intelectual, la privacidad o los derechos de imagen de terceros — incluido subir personajes u obras de terceros sin autorización;
crear, subir o compartir contenido sexual que involucre a menores — tolerancia cero; denunciamos dicho material a las autoridades competentes;
crear o compartir contenido pornográfico, sexualmente explotador o gratuitamente violento;
acosar, amenazar, difamar o promover el odio contra cualquier persona o grupo;
suplantar a cualquier persona o entidad, o crear contenido "deepfake" engañoso de personas reales;
usar el Servicio para fines ilícitos, o subir malware o código dañino;
hacer scraping del Servicio, acceder a él por medios automatizados o realizar ingeniería inversa de cualquiera de sus partes;
eludir o manipular el sistema de créditos, los filtros de contenido o las medidas de seguridad;
presentar contenido generado por IA como imágenes auténticas de hechos o personas reales con ánimo de engañar; o
infringir las políticas de las tiendas de Apple o Google al usar la app.

9. Moderación y medidas

Podemos — sin estar obligados — revisar contenido mediante herramientas automatizadas (como filtros de palabras clave) y revisión humana. Podemos retirar o restringir contenido, limitar funciones, o suspender o cancelar cuentas que razonablemente consideremos que infringen estos Términos o generan riesgo para usuarios, terceros o CharaGo. Las cuentas de infractores reincidentes serán canceladas. Si la cancelación se debe a un incumplimiento grave por su parte, los créditos no utilizados podrán perderse en la medida permitida por la ley aplicable. Para denunciar contenido o conductas, escriba a support@charago.app con un enlace o captura de pantalla y una breve descripción.

10. Reclamaciones de propiedad intelectual

Si considera que algún contenido del Servicio infringe sus derechos, envíe una notificación a support@charago.app que incluya: (a) la identificación de la obra protegida; (b) la ubicación del material presuntamente infractor dentro del Servicio; (c) sus datos de contacto; (d) una declaración de buena fe de que el uso no está autorizado; (e) una declaración, bajo pena de perjurio cuando proceda, de que su notificación es exacta y de que usted es el titular de los derechos o está autorizado para actuar en su nombre; y (f) su firma física o electrónica. Podremos retirar el material y notificar a quien lo subió, quien podrá presentar una contranotificación. Cancelamos las cuentas de infractores reincidentes.

11. Servicios de terceros; términos de las tiendas de aplicaciones

El inicio de sesión con Apple o Google está sujeto a sus términos. Las comunidades externas que enlazamos (como nuestro servidor de Discord) son operadas por terceros bajo sus propios términos y políticas.

Si descargó la app del App Store de Apple, se aplica lo siguiente: estos Términos son entre usted y CharaGo únicamente — no con Apple. Apple no es responsable de la app ni de su contenido y no tiene obligación de proporcionar mantenimiento o soporte. Si la app no se ajusta a una garantía aplicable, puede notificarlo a Apple y Apple le reembolsará el precio de compra de la app (si lo hubiera); en la máxima medida permitida por la ley, Apple no tiene ninguna otra obligación de garantía. Apple no es responsable de atender reclamaciones relativas a la app, incluidas las de responsabilidad por producto, cumplimiento legal o normativo, o protección del consumidor. Apple y sus filiales son terceros beneficiarios de estos Términos y podrán exigir su cumplimiento frente a usted. Usted declara que no se encuentra en un país sujeto a embargo del gobierno de EE. UU. y que no figura en ninguna lista de partes prohibidas o restringidas del gobierno de EE. UU., y acepta cumplir las Normas de Uso de los Términos de Servicio de Apple. Si descargó la app de Google Play, se aplican de forma análoga los términos de Google Play.

12. Exención de garantías

El Servicio se proporciona "tal cual" y "según disponibilidad." En la máxima medida permitida por la ley, rechazamos todas las garantías, expresas o implícitas, incluidas las de comerciabilidad, idoneidad para un fin determinado y no infracción, y no garantizamos que el Servicio sea ininterrumpido, seguro o libre de errores, ni que los Resultados cumplan sus expectativas. Algunas jurisdicciones no permiten ciertas exenciones, por lo que partes de esta sección podrían no aplicarse a usted; nada en estos Términos limita los derechos del consumidor irrenunciables conforme a la ley de su lugar de residencia.

13. Terminación

Por usted: puede dejar de usar el Servicio en cualquier momento y eliminar su cuenta en la app (Me → Account) o escribiendo a support@charago.app. Por nosotros: podemos suspender o cancelar su acceso por incumplimiento de estos Términos, riesgo legal o de seguridad, o inactividad prolongada (con aviso previo en caso de inactividad). Si descontinuamos el Servicio de forma permanente, avisaremos con antelación razonable, y los créditos comprados no utilizados se tratarán conforme exija la ley aplicable. Las Secciones 6(c) (en lo indicado), 7, 12, 14, 15 y 16 sobreviven a la terminación.

14. Limitación de responsabilidad

En la máxima medida permitida por la ley: (a) no seremos responsables de daños indirectos, incidentales, especiales, consecuentes o punitivos, ni de pérdida de beneficios, datos o fondo de comercio; y (b) nuestra responsabilidad total agregada por todas las reclamaciones relacionadas con el Servicio se limita a la mayor de estas cantidades: lo que usted nos haya pagado en los 12 meses anteriores al hecho que origina la reclamación, o 50 USD. Esta limitación no se aplica a la responsabilidad derivada de nuestra conducta dolosa o negligencia grave, a muerte o daños personales, ni a ninguna responsabilidad que no pueda limitarse conforme a la ley imperativa de su lugar de residencia.

15. Indemnización

En la medida permitida por la ley de su lugar de residencia, usted acepta indemnizar y mantener indemne a CharaGo frente a reclamaciones de terceros y gastos razonables (incluidos honorarios legales) derivados de su Contenido de Usuario o de su incumplimiento de estos Términos.

16. Ley aplicable y controversias

Estos Términos se rigen por las leyes de la Región Administrativa Especial de Hong Kong, con exclusión de sus normas de conflicto de leyes, y las controversias se someterán a los tribunales de Hong Kong — si bien, si usted usa el Servicio como consumidor, conserva la protección de las normas imperativas de protección del consumidor del país donde reside habitualmente, y nada en esta sección le priva del derecho a ejercitar o defender acciones ante sus tribunales locales cuando la ley imperativa así lo reconozca.

17. Cambios en estos Términos

Podemos actualizar estos Términos periódicamente. En caso de cambios sustanciales, avisaremos en la app o en nuestro sitio web con antelación razonable a la fecha de entrada en vigor. El uso continuado del Servicio tras esa fecha constituye aceptación; si no está de acuerdo, deje de usar el Servicio y elimine su cuenta.

18. Disposiciones varias; contacto

Estos Términos (junto con la Política de Privacidad) constituyen el acuerdo íntegro entre usted y CharaGo sobre el Servicio. Si alguna disposición se declara inaplicable, el resto permanecerá en vigor. Que no hagamos valer una disposición no supone renuncia. Podemos ceder estos Términos a una filial o al sucesor del Servicio; usted no puede cederlos. Estos Términos pueden publicarse en varios idiomas; en caso de discrepancia, prevalece la versión en inglés. Contacto: support@charago.app
